Please read these Terms and Conditions carefully before using the DiabetesConnect website, mobile app, and related services.
1. Acceptance of These Terms
These Terms and Conditions (“Terms”) govern your access to and use of DiabetesConnect (the “Service”), including the mobile application, website, and related features made available by Diabetes Connect LTD (“we”, “us”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
Your use of the Service is also subject to our Privacy Policy. Please read that policy carefully before using the Service.
2. Interpretation and Definitions
Interpretation
Words with capitalized initial letters have meanings defined below. These definitions apply whether they appear in singular or plural.
Definitions
For the purposes of these Terms:

Account means a unique account created for you to access or use parts of the Service.

Application means the DiabetesConnect mobile application.

Application Store means the Apple App Store or Google Play Store from which the Application is downloaded.

Company means Diabetes Connect LTD.

Content means text, images, video, audio, comments, messages, feedback, posts, profile information, and other material made available through the Service by you or others.

Device means any device that can access the Service, including a phone, tablet, or computer.

Feedback means suggestions, ideas, comments, or other feedback you provide regarding the Service.

In-App Purchase means any purchase of digital content, features, subscriptions, or services made through the Application and processed by an Application Store.

Service means the Application, the Website, and related services provided by DiabetesConnect.

Subscription means paid recurring access to features or services offered through the Service.

Terms means these Terms and Conditions.

Third-Party Service means any service, content, platform, tool, or provider not owned or controlled by DiabetesConnect that may be linked to, integrated with, or used in connection with the Service.

Website means the official DiabetesConnect website and related web pages operated by us at diabetesconnect.app.

3. Eligibility and Use of the Service
You may use the Service only if you are legally capable of entering into a binding agreement under applicable law.
If you are under the age required to enter into a binding agreement in your jurisdiction, you may use the Service only with appropriate parental, guardian, or other legally valid supervision or consent where permitted by law.
You agree to use the Service only for lawful purposes and in accordance with these Terms.
4. Health and Medical Information Disclaimer
DiabetesConnect is intended to support health tracking, education, and personal management. It is not a substitute for professional medical advice, diagnosis, or treatment.
The Service may allow you to record, view, analyze, or organize health and wellness information, including nutrition or diabetes-related information. However:

the Service does not provide medical diagnosis

the Service does not replace a doctor, pharmacist, dietitian, or other qualified healthcare professional

you should not ignore or delay seeking professional medical advice because of information shown in the Service

any nutrition estimates, insights, calculations, or AI-generated outputs are for informational purposes only and may not always be accurate
If you have a medical emergency, contact your doctor or emergency services immediately.
5. Accounts
Some features of the Service may require you to create or use an Account.
When you create or use an Account, you agree to provide accurate, current, and complete information and to keep that information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your Account. You must notify us promptly if you believe your Account has been accessed without authorization or if there has been any security breach.
We may suspend or terminate your Account if we reasonably believe you have violated these Terms or used the Service improperly.
6. Acceptable Use
You agree not to:

misuse community, social, posting, reaction, messaging, or similar features

use automated means to scrape, copy, or access the Service without authorization
We may investigate misuse and take action including content removal, account suspension, or termination.
7. User Content
The Service may allow you to submit, upload, post, or otherwise make Content available.
You remain responsible for any Content you submit and for ensuring that you have the rights necessary to share it.
By submitting Content through the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt, display, distribute, and otherwise use that Content only as reasonably necessary to operate, improve, promote, and provide the Service.
You represent and warrant that:

We may remove or restrict Content that we believe violates these Terms or may harm the Service, users, or third parties.
8. Feedback
If you provide Feedback to us, you agree that we may use it without restriction or compensation to you. This includes the right to use, reproduce, modify, adapt, publish, and incorporate your Feedback into the Service or our business operations.
9. Subscriptions and In-App Purchases
Certain features of the Service may be offered through paid Subscriptions or other In-App Purchases.
All In-App Purchases are processed through the relevant Application Store, such as:

Google Play Store
By purchasing a Subscription or other In-App Purchase, you agree that:

billing, payment processing, renewals, and refunds are handled by the relevant Application Store

your purchase is also subject to that store’s own terms, policies, and refund rules

we do not store your full payment card details
10. Subscription Renewals and Cancellation
If you purchase a recurring Subscription, it may automatically renew unless you cancel it through the relevant Application Store before the renewal date.
You are responsible for managing and cancelling your Subscription through your Apple App Store or Google Play Store account settings where applicable.
Unless required by law or otherwise provided by the Application Store’s policies, Subscription fees already paid are non-refundable.
11. Pricing and Changes to Paid Features
We may change pricing, subscription plans, features, or availability of paid services from time to time.
Where required, changes to recurring subscriptions will take effect in accordance with the rules of the relevant Application Store and applicable law.
We may also modify, replace, suspend, or discontinue any part of the Service at any time.
12. Promotions and Trials
From time to time, we may offer free trials, promotional pricing, temporary access, or other offers. These may be subject to additional terms.
We may modify or withdraw promotions or trial offers at any time, to the extent permitted by law and applicable platform rules.
13. Intellectual Property
The Service, including its design, branding, software, features, functionality, text, graphics, logos, and other materials, is owned by or licensed to Diabetes Connect LTD and is protected by intellectual property laws.
Except as expressly permitted in these Terms, you may not copy, modify, reproduce, distribute, license, sell, reverse engineer, or otherwise exploit any part of the Service without our prior written consent.
DiabetesConnect and related branding may not be used without permission.
14. Copyright Complaints
We respect the intellectual property rights of others. If you believe that any content on the Service infringes your copyright or other intellectual property rights, please contact us with sufficient detail so we can review the issue.

15. Third-Party Services

16. Availability and Changes to the Servic
We may update, modify, suspend, or discontinue all or part of the Service at any time, with or without notice.
We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free, or that defects will always be corrected.
17. Termination
We may suspend or terminate your access to the Service or your Account at any time if we reasonably believe that:

To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
19. Limitation of Liability
To the fullest extent permitted by law, Diabetes Connect LTD and its affiliates, licensors, service providers, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity arising out of or related to your use of, or inability to use, the Service.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed:

the amount you paid to us through the Service in the 12 months before the claim arose, or

USD 100, if you have not made any payment through the Service,
whichever is greater.
Nothing in these Terms excludes or limits liability that cannot be excluded by applicable law.

You agree to indemnify and hold harmless Diabetes Connect LTD and its affiliates, officers, representatives, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles, except where mandatory consumer protection laws in your country of residence apply.

If we make material changes, we may provide notice through the Service or by other reasonable means. By continuing to use the Service after updated Terms take effect, you agree to the revised Terms.
